This one is really two questions wearing one trench coat:

  1. Can the State Department issue you a passport while you're on probation?

  2. Are you allowed to travel while you're on probation?

The answers are usually "yes" and "read your conditions" — and mixing them up is how people earn probation violations.

Question 1: Will the passport be issued?

In most cases, yes. Being on probation isn't, by itself, on the federal list of passport disqualifiers. The exceptions:

  • The drug-offense rule. Federal law directs denial for people still imprisoned, on parole, or on probation for certain federal or state drug convictions — mainly where the offense involved crossing international borders. If your probation is for a drug offense, assume this needs checking.

  • A court order says no. If your sentencing order or conditions of release explicitly bar you from obtaining a passport or leaving the country, that controls.

  • The usual suspects that apply to everyone: outstanding felony warrants, child-support arrears of $2,500+, and seriously delinquent tax debt.

Question 2: Are you allowed to travel?

This is where people get hurt. Standard probation conditions restrict you to your county or state unless your probation officer approves otherwise; federal supervised release typically requires permission to leave your judicial district. A passport in your pocket doesn't override any of that. Leaving without approval is a violation — and a violation can mean revocation and serving the sentence.

The right sequence:

  1. Read your actual conditions. Not what a forum said — your signed order.

  2. Ask your probation officer in writing. Dates, destination, reason, contact info while away.

  3. International trip? Expect to need a judge's sign-off in many jurisdictions, especially on felony probation.

  4. Only then book travel.

After probation

Once probation ends, the travel-permission problem evaporates. A criminal record alone doesn't stop a U.S. passport — see the specifics for felony records and misdemeanors, or the full list of what can actually stop you. On probation for a DUI specifically? That has its own quirks — including Canada's border rules.
